Terms of Use

1. Acceptance
These terms are an agreement between you and Richard James Nichols, as The Game Project in Victoria, Australia. By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service.
2. Eligibility
You must be at least 16 years old and legally capable of agreeing to these terms to create an account. If we reasonably believe an account is held by someone under 16, we may restrict or close it and delete the associated information, subject to applicable law.
3. The service
The Game Project provides tools for managing game collections, backlogs, gameplay history and related information. Features may change as the service develops.
4. Beta service
The service is currently offered in beta and without charge. Beta features may be incomplete, contain errors, change materially or be withdrawn before general release. Participation in the beta does not guarantee that any feature will become generally available or remain free. Nothing in this section excludes rights or remedies that cannot lawfully be excluded.
5. Accounts
You must provide accurate account information, keep your account credentials secure and promptly notify us if you believe your account has been compromised. You are responsible for activity you authorise through your account. You must not share access in a way that creates a security risk or allows another person to misuse the service.
6. Your content
You retain ownership of information, images, lists and other content you add to the service. You must have the rights needed to upload that content.
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process and display your content solely as needed to operate, improve and secure the service.
7. Our intellectual property
The service, including its software, design, branding, interfaces and original content, is owned by Richard James Nichols or licensed to us and is protected by intellectual property laws. These terms do not transfer ownership of that material to you. You may use the service only as permitted by these terms and must not copy, modify, distribute, sell, lease, reverse engineer or create derivative works from it except where permitted by law.
You may provide feedback voluntarily. We may use that feedback to develop and improve the service without an obligation to compensate you.
8. Acceptable use
Do not misuse the service, interfere with its operation, attempt unauthorised access, distribute malware, engage in fraud or impersonation, harass or threaten others, or use automated methods that place an unreasonable load on the service.
Do not upload content that is unlawful, infringes intellectual property or privacy rights, contains hateful or sexually exploitative material, or otherwise creates a serious risk of harm to another person or the service. We may remove sexually explicit or other adult content unless it is presented in an appropriate, non-exploitative context directly related to cataloguing or discussing a game.
9. Game information
Game descriptions, artwork and other metadata may be supplied by third parties. We do not guarantee that this information is complete or error-free, and third-party material remains subject to its owners’ rights.
10. Availability
The service and its features may change over time. We may modify, suspend or discontinue all or part of the service for operational, security or business reasons. Where reasonably practicable, we will provide advance notice of a material discontinuation and an opportunity to export your data. We do not guarantee uninterrupted availability, and temporary outages may occur.
11. Content moderation and termination
We may remove or restrict access to content where we reasonably believe it breaches these terms, infringes another person's rights, is unlawful, or creates a security or safety risk. Where appropriate, we may consider the nature and seriousness of the issue, whether it is repeated, and whether a less restrictive response is available.
You may stop using the service at any time. We may suspend or terminate your access if you materially breach these terms, create a security or legal risk, misuse the service, or if suspension is reasonably necessary to protect the service or other users. We may also terminate an account for legitimate operational or business reasons. Where reasonably practicable, we will provide advance notice and an opportunity to export your data. We may act without notice where immediate action is reasonably necessary for security, legal or abuse-related reasons.
12. Effect of termination
When your account is terminated, you will lose access to the service and your content. Where reasonably practicable, we will give you an opportunity to export available content before deletion, unless immediate action is required for legal, security or safety reasons. We may delete account content after termination, subject to reasonable backup periods and any information we must retain for legal, security, fraud-prevention or dispute-resolution purposes.
13. Liability
To the extent permitted by law, The Game Project is not liable for indirect, incidental or consequential loss arising from use of the service. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded.
14. Changes to these terms
We may update these terms as the service changes. We will give reasonable advance notice of changes that materially affect your rights or obligations, normally by email or through the service. Changes may take effect immediately where reasonably necessary to comply with law, address a security or safety risk, or make minor technical or administrative corrections. The notice will state when the updated terms take effect. If you do not agree to a material change, you may stop using the service before it takes effect.
15. Governing law
These terms are governed by the laws of Victoria, Australia. You and we submit to the courts of Victoria and courts entitled to hear appeals from them. Nothing in this section limits any rights you have under applicable consumer law or your ability to bring a claim in another forum where that right cannot lawfully be excluded.
16. Reporting content
If you believe content on the service infringes your intellectual property or privacy rights, is unlawful, or breaches these terms, please report it to safety@thegameproject.net with enough information for us to identify and assess the content. We may preserve or disclose information where reasonably necessary to investigate a report, comply with law or protect a person's rights or safety.
